Terms of Use

These Terms of Use ("Terms") govern your use of mindtreks.com (the "Site") and any retreat or service offered by MindTreks LLC ("MindTreks," "we," "us"). By using the Site or booking a retreat, you agree to these Terms. If you do not agree, please do not use the Site or book a retreat.

1. Eligibility

The Site and our retreats are intended for adults aged 18 years or older. By using the Site or booking, you represent that you are at least 18. If you are using the Site on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. The Site is informational

Content on this Site — including blog posts, retreat descriptions, and information about practices we teach — is for general informational purposes only. Nothing on the Site is medical, psychological, legal, or financial advice. We do not claim that our retreats will treat, cure, prevent, or diagnose any condition. If you are managing a health condition, consult a qualified healthcare professional before booking.

3. Bookings

A retreat booking is formed only when (a) you submit a completed booking through our process, (b) you pay the required deposit, and (c) we send a written booking confirmation. Until all three have occurred, no booking exists and we may decline any request at our discretion.

4. Pricing and payment

Retreat prices are stated in U.S. dollars and are per person, all-inclusive of lodging, meals, on-trail snacks, U.S. Forest Service permits, and local ground transport between our lodge and trailheads. Prices do not include airfare, travel insurance, gratuities, or optional add-ons.

A deposit of 30% of the retreat fee is required to hold a booking. The remaining balance is due 30 days before the retreat start date. Payments are processed through Stripe; we do not store full payment card details.

5. Cancellation and refund policy

This policy applies to participant-initiated cancellations. The MindTreks-initiated cancellation policy is in section 6.

We strongly recommend trip-cancellation and travel-medical insurance. We do not sell insurance and we do not receive referral fees from any insurance provider.

6. Cancellation or modification by MindTreks

We may cancel or modify a retreat in case of conditions outside our reasonable control — including but not limited to severe weather, wildfire, road or trailhead closures, public-health restrictions, or a guide medical emergency. In that case, we will offer (a) a full refund of all amounts paid, or (b) transfer to a future retreat at no additional cost. We are not responsible for non-refundable third-party costs you may have incurred (airfare, lodging outside our program). This is one of the reasons we recommend travel insurance.

7. Participation requirements and conduct

Every participant must complete an intake form before the retreat. This includes disclosure of any medical condition that could reasonably affect safe participation in moderate-to-strenuous backcountry walking. We may decline a booking, or end a participant's retreat early without refund, if (a) the participant has not honestly disclosed material information, (b) the participant's behavior endangers themselves or others, or (c) the participant is using illegal substances or arrives intoxicated. Tobacco and alcohol are not permitted on the trail or during practice sessions.

8. Assumption of risk

Hiking and snowshoeing in the backcountry involve inherent risks — including but not limited to slips and falls, exposure to weather, wildlife encounters, altitude effects, and remote-area medical response times. By booking a retreat you acknowledge these risks and agree that you participate voluntarily. Before each retreat, you will be asked to sign a separate Liability Release that contains the operative legal language for this point. The signed Liability Release controls in the event of any conflict with this section.

9. Intellectual property

All content on this Site — text, images, illustrations, and code — is owned by MindTreks LLC or used with permission, and is protected by U.S. and international copyright law. You may quote short passages with attribution; you may not republish substantial portions or reproduce the Site's design elements without our written consent.

10. User-submitted content

If you submit content to us (testimonials, photos, written feedback), you grant us a non-exclusive, royalty-free license to use it for the operation of MindTreks, including on the Site, provided that we honor any restriction you specify in writing. You retain ownership of your content. We do not publish testimonials we have not been able to verify with the author.

11. Third-party links and services

The Site contains links to third-party websites (e.g. our payment processor, certain government and educational resources). We are not responsible for the content, policies, or practices of those third parties. The fact that we link to a site is not an endorsement.

12. Disclaimers

The Site is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, although we take reasonable steps to make it so.

13. Limitation of liability

To the maximum extent permitted by applicable law, MindTreks' total liability for any claim arising out of or relating to these Terms or your use of the Site is limited to the amount you paid us in the 12 months preceding the claim, or fifty United States dollars (US$50.00) if you have not paid us anything. Neither party will be liable for indirect, incidental, special, consequential, or punitive damages. Nothing in this section limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law (including, for retreat participants, any liability that cannot be released under the operative Liability Release).

14. Indemnification

You agree to indemnify and hold MindTreks harmless from any claim brought by a third party arising out of your breach of these Terms or your violation of any law or third-party right in connection with your use of the Site.

15. Governing law and venue

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. Any dispute arising under or relating to these Terms or the use of the Site that is not resolved through good-faith negotiation will be brought exclusively in the state or federal courts located in Deschutes County, Oregon, and you consent to the personal jurisdiction of those courts. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

16. Changes to these Terms

We may revise these Terms from time to time. If we make a material change, we will update the "last updated" date above. For changes that materially affect bookings already in progress, we will email the affected participants. Continued use of the Site after a change constitutes acceptance of the revised Terms.
